THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2208 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner/A.3 challenging the order, dated 24.04.2015 passed in Crl.M.P (SR) No.5637 of 2014 in C.C.No.1699 of 2012 passed by the learned XI Additional Chief Metropolitan Magistrate, Secunderabad, whereby the learned Judge dismissed the petition filed by the petitioner/A.3 along with others to recall the Non Bailable Warrants (NBWs) issued against the petitioner/A.3 along with A.1, A.2 and A.5.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is seriously ill and is not in a position to present before the Court and as such, prays this Court to recall the NBW issued against the petitioner/A.3. Considering the facts and circumstances of the case, the revision case is disposed of with a direction to the petitioner/A.3 to surrender before the Court concerned and file an application to recall NBW issued against him and on such application, the Court below is directed to recall the NBW on the same day. Further, the petitioner is directed to appear before the Court concerned regularly on all hearing days.

The criminal revision case is accordingly disposed of. Miscellaneous petitions, if any, pending in criminal revision case, shall stand closed.
