HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.10681 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner/A2 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.1021 of 2015 of L.B.Nagar Police Station, Cyberabad District, registered for the offence punishable under Sections 418, 493, 497, 506 and 380 r/w 34 I.P.C, which is outcome of the report of the 2nd respondent/de facto complainant. Heard the learned counsel for the petitioner and the learned Public Prosecutor for the State before notice to respondent No.2 and before admission. Perused the material on record.

A1 is no other than wife of the de facto complainant and the allegations so far as the petitioner/A2 is that he got illicit relation with A1. It is the submission of the learned counsel for the petitioner that the case so far as A1 is already settled for compromise and the police investigation is only confined to the petitioner/A2. Even then the material requires investigation. Thereby, the facts fall short for this Court to admit the application for quashing of F.I.R. proceedings but for to say the factual matrix entitled to the concession of bail, this application is disposed of giving liberty to the petitioner to surrender before the learned Magistrate concerned and move for regular bail with notice to the Additional Public Prosecutor on same day and in such an event the learned Magistrate shall hear and grant bail on the same day with necessary conditions. Accordingly, this Criminal Petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. _________________________ Dr. B. SIVA SANKARA RAO, J
