THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.9379, 9380, 9381 and 9392 OF 2015 COMMON ORDER :

As the issue involved in all these writ petitions is one and the same, they are being disposed of by way of this Common Order. All these writ petitions are filed assailing the impugned notices dated 23.02.2015 and 27.02.2015 issued under Section 441 of the Hyderabad Municipal Corporation Act, 1955 ( for brevity 'the Act') by the respondent Corporation. Some of the petitioners have filed explanations along with copies of building permissions and necessary documents and some of the petitioners have not filed any explanation to the impugned notices and sought time to file explanations. In the meanwhile, the respondent Corporation is trying to demolish the properties, though the petitioners are having valid building permissions.

Heard learned counsel for the petitioners as well as Sri C.V.Bhasker Reddy, learned Standing Counsel for the respondent Corporation. Sri C.V.Bhasker Reddy, learned Standing Counsel for the respondent Corporation submits that only after considering the representations of the petitioners, appropriate action will be initiated. In view of the submission of the learned Standing Counsel for the respondent Corporation, since some of the petitioners have filed explanations to the impugned notices, it is open for the petitioners, who have not filed explanations so far, to file the same within a period of ten days and the respondent Corporation is directed to consider the same and pass appropriate orders, in accordance with law. Till then, Status quo obtaining as on today shall be maintained. However, if the petitioners do not file explanations within the stipulated time, it is for the respondent authorities to take action as per law. With the above direction, these writ petitions are disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any
