THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4564 OF 2016 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.64 of 2016 on the file of the Dachepalli Police Station, Dachepalli Mandal, Guntur District, registered for the offence punishable under Sections 420, 285 IPC, Section 7 of the Essential Commodities Act and Section 22 (b) of the Petroleum Act.
Heard and perused the material available on record. It is alleged that the petitioner and other accused were found transporting kerosene illegally with negligent conduct with respect to fire or combustible matter petroleum and cheating the people and the Government, Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is inclined to pass the following order:
"The petitioner is directed to surrender before the 1st respondent-police concerned and on such surrender, the petitioner shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the 1st respondent-police concerned. The 1st respondent-police concerned are directed to complete the investigation, without arresting the petitioner. The petitioner is directed to appear before the 1st respondent-police concerned as and when required for the purpose of investigation." Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
