THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6979 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime No.728 of 2023, on the file of P.S., Narsingi, Cyberabad, registered for the offences under Sections 304-part II and 337 of IPC and 184 and 187 of the Motor Vehicle Act, 2019.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The case of the prosecution is that on 04.07.2023, A-1 was driving, petitioner/A-2 was sitting in the front and three other friends were in a Honda Civic Car. A-1, while driving ran over two persons. Both of them died. For the reason of said accident, F.I.R. was registered for the offence under Sections 304-part II and 337 of IPC and 184 and 187 of the M.V.Act.

Learned counsel for the petitioner would submit that this petitioner is A-2 and even according to the remand report, the petitioner was not driving the car. 5.

Keeping in view that the petitioner is a student and is in jail from 05.07.2023 and further the petitioner was not driving the car, this Court deems it appropriate directing release of this petitioner on bail subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of XIII Additional Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner/Accused No. 2 after release shall appear before the concerned Station House Officer as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
