HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CIVIL REVISION PETITION No.539 of 2016 ORDER:
Heard the submission of learned counsel appearing for the parties.

Both learned counsel submitted that the suit is of the year 2012 and therefore, a direction may be issued to the trial Court to dispose of the suit itself on merits time bound and they are not intending to agitate before this Court either the merits in I.A.No.281 of 2012 in O.S.No.118 of 2012 pending on the file of the Court of Principal Junior Civil Judge, Huzurabad basing on which CMA No.5 of 2013 was preferred before the Court of Senior Civil Judge, Huzurabad on its legality.

As per the material available on record, I.A.No.281 of 2012 was filed by the plaintiff to the suit under Order 39 Rules 1 and 2 C.P.C. seeking temporary injunction and the said request was dishonoured by the trial Court and aggrieved by it, the petitioner/plaintiff filed CMA challenging that order and the said appeal was allowed and aggrieved by the judgment rendered in the said civil miscellaneous appeal, the defendants preferred the present CRP.

Having considered the submissions of both counsel, this Court considers desirable to dispose of CRP in the terms as requested by both counsel appearing for the parties. The
Dr.CSL , J CRP_539_2016 Principal Junior Civil Judge, Huzurabad is directed to dispose of the suit in O.S.No.118 of 2012 pending on its file within three months from the date of receipt of a copy of this order. Till then, as requested by both counsel, both parties shall maintain status quo.

With the above directions, the civil revision petition is disposed of without costs.
Pending Miscellaneous Petitions, if any, shall stand closed.
