THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23663 OF 2004 ORDER:

This writ petition is filed challenging the punishment of recovery of an amount of Rs.6,873/- on the allegation of unaccountal of material vide proceedings No.

SO (R&W)/69/GII/D/99-2000-VZM dated 02-01-2004 as arbitrary and illegal.

Learned counsel for the petitioner contended that the respondents could not have imposed such a punishment after handing over of charge by the petitioner.

This Court having considered the above said submission is of the considered view that there is no interim order in the case, the punishment of recovery of Rs.6,873/- has worked out itself and the petitioner is on the verge of retirement. Since the punishment imposed by the respondents has been implemented and no grave procedural irregularity or impropriety has been pointed out in the punishment order, this Court is not inclined to interfere with the said order. There are no merits in the writ petition. 4.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
