SIVA SANKARA RAO WRIT PETITION No.38707 of 2015 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the auction notice published on 30.10.2015 proposing to hold the auction sale on 30.11.2015. Conditional interim order was granted by this Court on 27.11.2015 staying further proceedings pursuant to the impugned auction notice.

However, it is fairly admitted by Sri Chintha Appi Reddy, learned counsel for the petitioner, that the conditional order has not been complied with.

Sri V. Raghu, learned counsel for the respondent bank, would however inform us that the sale scheduled to be held on 30.11.2015 did not materialize for want of bidders.

In that view of the matter, the challenge in this writ petition as against the impugned auction notice published on 30.10.2015 is rendered purely academic and does not warrant consideration on merits.

The writ petition is accordingly dismissed leaving all issues open. Interim order dated 27.11.2015 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
