THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos. 11148 and 11207 of 2017 COMMON ORDER:

These two writ petitions are being disposed of by this common order as the grievance of the petitioner is with regard to the freezing of its account in two different banks.

It appears that respondent No.4-Station House Officer, MVP Police Station, Visakhapatnam registered a case in Crime No.425 of 2016 pursuant to the complaint lodged by respondent No.5 and issued a notice under Section 91 of the Code of Criminal Procedure on 16.11.2016 to freeze the accounts of the petitioner in respective banks.

Now, the learned counsel for the petitioner filed additional documents, wherein it is brought to the notice of respondent No.4 with regard to the withdrawal of the complaint lodged by respondent No.5 against the petitioner pursuant to settlement of the matter and entering into an MOU.

In view of the same, respondent No.4 is directed to consider the representation, dated 24.03.2017, submitted by the petitioner and pass appropriate orders for de-freezing the accounts, within a period of one week from the date of receipt of a copy of this order and also take necessary steps for closure of the complaint, in accordance with law.

At this stage, learned Government Pleader for Home, submits that there is no acknowledgment of receipt of the representation, dated 24.03.2017, by respondent No.4. If that be so, the petitioner

can approach respondent No.4 in person and submit the representation.

The writ petitions are accordingly disposed of. Miscellaneous petitions, if any, pending in these writ petitions shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:04.04.2017 Note: Issue cc in two days.
