HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1786 of 2015 in Crl.P.No.1055 of 2015 and Criminal Petition No.1055 of 2015 COMMON ORDER:
De-facto complainant and her counsel Sri K.Pinakapani are present. Accused and their counsel Sri N.Nanda Kishore are present.
On the report given by defacto complainant the police of Musheerabad PS, Hyderabad registered Cr.No.214 of 2014 against the accused for the offences under Sections 354, 341 and 290 IPC and investigation is stated to be pending. The allegation is that the accused some time back developed friendship with defacto complainant and wanted to marry her and her parents refused the same and thereafter he married another girl. While so, on 23.05.2014 while defacto complainant was proceeding on his two wheeler to go to her job, the accused followed her, stopped and caught hold and tied yellow thread in her neck and proclaimed as if they have married and asked her to come along with him and thus created nuisance.
While so, the parties along with their counsel attended the Court today and submitted that at the intervention of elders they have amicably settled their disputes and there is no threat for the defacto complainant from the accused side and they want to live peacefully and therefore, defacto complainant has no objection
for quashment of proceedings in Cr.No.10 of 2014 against the accused and hence they may be permitted to compound the offence and quash the proceedings in the interest of justice. Having regard to the above submission and considering the fact that the nature of allegations alleged against the accused are not grave ones and further the parties submitted that at the intervention of elders they have settled their disputes and further when the Court questioned about the threat the defacto complainant has expressed that there is no threat from the accused and no useful purpose will be served even if the investigation is allowed to be continued, and following the decision reported in Gian Singh v. State of Punjab and another (2012) 10 SCC 303) this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in Cr.No.214 of 2014 are hereby quashed in terms of joint memo filed by the parties. In the result, the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
