HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.40309 OF 2014 PC: (Per the Hon'ble Sri Justice S.V.Bhatt) The petitioners filed the writ petition with the following prayer: ".....to issue an appropriate writ, order or .direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not issuing the proceedings in favour of the petitioners under proviso to Sub-section 6 of section 3 of A.P. Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 for the lands with an extent of Ac.19-32 guntas in Sy.No.
356/1E1, 356/1E1/2, 356/1E1, 356/1E/2 and 356/3E1 of Pregnapur Village, Gajwel Mandal, Medak District is highly illegal, arbitrary and in violation of Article 14 of the Constitution of India and consequently direct the 2nd respondent to forthwith issue the proceedings in favour of the petitioners under proviso to sub-section 6 of section 3 of A.P. Agricultural Land (Conversion for NonAgricultural Purposes) Act, 2006 for the, lands with an extent of Ac.19-32 guntas in Sy.No.356/1E1, 356/1E1/2, 356/1E1, 356/1E1/2 and 356/3E1 of Pregnapur Village, Gajwel Mandal, Medak District by collecting the Conversion fee and pass such other......."
The prayer is against alleged inaction in considering and disposing of the application of petitioners under the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006.
This Court on 29.12.2014 passed the following interim order: "Notice before admission returnable in eight weeks.
In the meantime, the application said to have been submitted by the petitioners on 22.09.2014 may be considered in accordance with law".
The learned Government Pleader for Revenue (TS) submits that
the 2nd respondent will consider and pass appropriate orders on the representation, if not already disposed of, within a period of eight weeks from the date of receipt of a copy of this order. Having regard to the limited submissions of learned counsel appearing for the parties, we are satisfied the writ petition can be disposed of in the following terms:
"The 2nd respondent shall consider and dispose of the representation dated 22.09.2014 of petitioners within a period of six weeks from the date of receipt of a copy of this order, if the said representation is not disposed of by now, in terms of the interim order dated 29.12.2014. The petitioners are given liberty to communicate a copy of this order along with a copy of representation dated 22.09.2014 for expeditious and prompt decision by the 2nd respondent". The writ petition is, accordingly, disposed of. Consequently, miscellaneous petitions, if any pending, also stand disposed of.
