ORDER :

The petitioner is working as General Mazdoor. According to the petitioner, he is not keeping good health and cannot discharge his duties properly. However, he was examined by Medical Officer and he was declared fit. Petitioner made a representation to the 4th respondent on 6.5.2019 stating that since his health condition is not permitting him to discharge the duties, requested to refer his case to Corporate Medical Board.

Learned Standing Counsel appearing for RespondentCompany produced copy of the minutes of the Corporate Medical Board dated 26.7.2019, which reflects that the petitioner was examined by the Medical Board and was declared fit for the same job.

Since the petitioner was already examined by the Medical Board, the cause in the writ petition does not survive for further adjudication. Accordingly, the writ petition is dismissed, leaving it open to the petitioner to work out his remedies as available under law against the report of the Corporate Medical Board.
