HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.17687 of 2009 ORDER:
This writ petition is filed to declare the action of the 4th respondent in not issuing fresh NOC in pursuance to the letter dt.1.12.2008 of the 2nd respondent to grant quarry lease in favour of the petitioner as illegal and arbitrary.
An interim direction, as prayed for, was granted on 30.10.2009.
Learned Government Pleader submits that the petitioner has submitted an application for grant of quarry lease for road metal over an extent of 6.00 hects., in Sy.No.24 of Puligogulapadu village, Addategala Mandal, East Godavari District for a period of 10 years; after receipt of the said application, office of the Assistant Director of Mines and Geology, Rajamahendravaram, has forwarded one set of application to revenue authorities for clarification and availability of the applied area but no report has been received from the revenue department; the office of the Assistant Director of Mines and Geology addressed a letter to the petitioner with a request to pay the differential amount as per G.O.Ms.No.81 dt.1.6.2017, but the petitioner has failed to pay the said amount; the office of the
Assistant Director of Mines and Geology has submitted rejection proposals to the Deputy Director of Mines and Geology, Kakinada, on 20.3.2018 and basing on the said proposals, the Deputy Director of Mines and Geology, Kakinada, issued show cause notice to the petitioner on 13.4.2018 to show cause as to why her application should not be rejected and the said application is under process.
Learned counsel for the petitioner and the learned Government pleader submitted that no further orders are necessary in the writ petition in view of the subsequent developments.
Hence, the Writ Petition is closed as no further orders are necessary. No order as to costs.
