HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.22133 OF 2009 O R D E R :
The petitioner prays for the following relief: "....issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the impugned action of the respondents 3 and 4 in not allowing the petitioner to duty and thereby disengaging him from service while continuing the juniors to the sub-stations under the control of the 3rd respondent which is highly illegal, arbitrary and violative of Art.
14 and 21 of the Constitution of India apart from violative of principles of natural justice by also declaring the action of the respondents in practicing contract labour system in sub-stations maintained under the control of respondents 1 to 3 herein while the work in the sub-station is of perennial nature and consequently direct the respondents to adopt a scheme for considering the contract labour worked or working in the sub-stations under the control of the respondents 1 to 3 herein in view of the Judgment of the Hon'ble Supreme Court in Haryana State Electricity Board and consequently direct the respondents to consider the petitioner for absorption in the regular vacancies in the category of Shift Operator or any other suitable post in the substations under the control of respondents 1 to 3 herein.."
On 15.10.2009, this Court granted interim direction as prayed for.
Learned standing counsel, on instructions, submits that the petitioner has been continuing as 'Shift Operator' in the Sub-Station. Learned counsel for petitioner requests the Court to make the interim order as final order.
The writ petition is disposed of by making interim order as final order. No order as to costs.
