THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.5226 of 2007 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in CC.No.10 of 2006 on the file of the Special Judge, CBI Cases, City Criminal Courts, Hyderabad, registered for the offences under Sections 120-B r/w.Sec.420 and 471 IPC and under Section 13(2) r/w.Sec.13(1) (d) of P.C.Act, 1988.

Heard the learned counsel appearing for the petitioner and the learned Special Public Prosecutor appearing on behalf of CBI. It is apparent from the record that pending the above calendar case before the trial Court, the petitioner/A1 filed the present criminal

petition. This Court by orders dated 12.06.2008 and 13.08.2008 gave liberty to the petitioner/A1 to approach the trial court with a petition to discharge him, if he is so advised. It appears that pursuant to the liberty given, the petitioner/A1 has filed Crl.MP.No.248/2009 in the above calendar case under section 239 Cr.P.C and the same has been dismissed.

Aggrieved by the same, the petitoner/A1 filed Crl.RC.No.519/2009. In that view of the matter, the present criminal petition has become infructuous and no further orders need be passed. The Criminal Petition is accordingly dismissed, however, without prejudice to the contentions of the petitioner/A1 that are raised in Crl.RC No.519/2009.

Pending miscellaneous applications, if any, shall stand closed in consequence.
