THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40214 of 2012 ORDER:

Petitioners challenge the legality of proceedings Rc.No.316/ 2012(B) dated 12-11-2012 of 4th respondent as illegal, arbitrary and unconstitutional and also complain against inaction of 3rd respondent in considering the stay petition filed by petitioners in the appeal against the order dated 12-11-2012 and passing appropriate orders, as amounting to not exercising jurisdiction vested in 3rd respondent.

Counsel appearing for parties submit that the appeal filed by petitioners against order dated 12-11-2012 is still pending with 3rd respondent.

Since the appeal is pending for more than three years, this Court considers it appropriate to direct 3rd respondent to dispose of Appeal No.Rc(B)2500/ 12, within four weeks from the date of receipt of a copy of this order. 3rd respondent issues notice to parties and disposes the appeal in accordance with law. It is made clear that this Court has not considered the merits of the matter and has taken note of the inaction complained by petitioners and the instant direction has been issued.
