THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17417 of 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise. The present writ petition is filed questioning the inaction of the second respondent in considering the petition dated 05.09.2015 made by the petitioner seeking interim custody of the vehicle bearing registration No.AP12V 3646, which was seized in PCOR No.575 of 2015-16.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the Deputy Commissioner of Prohibition and Excise, Mahbubnagar to dispose of the application filed by the petitioner seeking release of the above mentioned vehicle at the earliest.
It is not in dispute that pursuant to the application made, the Deputy Commissioner of Prohibition and Excise called for issuance of valuation certificate of the said vehicle from the Motor Vehicle Inspector.
Having regard to the circumstances stated above, the second respondent i.e., the Deputy Commissioner of Prohibition and Excise, Mahbubnagar Division at Mahbubnagar, is directed to dispose of the application filed by the petitioner, in accordance with law, within one week from 15.06.2016.
Accordingly, the writ petition is disposed of. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs.
