Heard both sides.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the inaction of respondent-police in taking up investigation in Crime No.138 of 2016 of Nellore VI Town Police Station, SPSR Nellore District, registered for the offences punishable under Sections 420 and 406 of IPC, as illegal and arbitrary. 3.

A counter came to be filed by the respondents stating that six witnesses were examined and a notice under Section 41-A of Cr.P.C. was also served on the accused on 13.02.2017. Further, it is stated that on 12.04.2017, the investigating officer addressed a letter to the Branch Manager, Andhra Bank, Balaji Nagar Branch, Nellore, under Section 91 of Cr.P.C. to furnish details of bank account bearing No.016913046000144 of the accused, M.Sreedhar Reddy and to return the cheque bearing No.142263 amounting to Rs.27,89,458/ - on the ground that the bank account of the accused was closed. It is further stated that so far the above mentioned details are not received from the Andhra Bank, Balaji Nagar, Nellore. Soon after receipt of the above details, the investigation would be finalized and an appropriate report under Section 173 Cr.P.C. would be filed before the concerned Court. 4.

In view of the above, it cannot be said that there was inaction on the part of respondent police in investigating the case.

Having regard to the above circumstances and since the investigation is over, this Court is of the view that no further orders are necessary in the writ petition.

Accordingly, the writ petition is closed. No costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall also stand closed.
