HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32587 of 2017 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in trying to release compensation amount in favour of respondent Nos.6 and 7 in respect of land admeasuring Ac.11.13 gts., in Sy.No.330/ 9 of Seetharamnagar Revenue Village, Kukunoor Mandal, West Godavari District, as illegal, arbitrary and violative of principles of natural justice; and consequently direct respondent No.4 to refer the matter to a competent authority. 2) The main grievance of the petitioner is that though he made objections with regard to title of the subject land, but the respondent-authorities are trying to pay compensation to respondent Nos.6 and 7 without considering the objections. 3) Government Pleader for Land Acquisition would submit that the objections made by the petitioner are pending and the same will be considered by the authorities.
4) Without going into merits of the case, the present Writ Petition is disposed of directing the authorities to consider the objections made by the petitioner in respect of land admeasuring Ac.11.13 gts., in Sy.No.330/ 9 of Seetharamnagar Revenue Village, Kukunoor Mandal, West Godavari District, before releasing compensation to respondent Nos.6 and 7.
5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
