The Respondents 1 to 3 in the appeal filed the above petition, along with death certificate of the sole appellant, stating that the appellant died on 21.09.2011, and therefore, prayed to dismiss the appeal as abated.

In view of the above, the petition is allowed, and the main appeal is dismissed as abated. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
