When the matter is taken up, it is submitted by the learned counsel for the petitioner that in somewhat identical situation this Court allowed W.P.No.25716 of 2017, dated 09.08.2017, by noting that no opportunity was afforded prior to issuing impugned notice and the same is not disputed by the learned Government Pleader.

In view of the same, following the above said order and for the reasons stated therein, this writ petition is also allowed, setting aside the impugned notice bearing Rc.No.140/2017/A3, dated 28.07.2017. It is open for the respondents to issue notice and proceed in accordance with law, if they are advised to do so. No order as to costs.
