W.P.No.22931 of 2015 ORDER:

The grievance in the present writ petition filed under Article 226 of the Constitution of India is inaction on the part of the Police in not acting on the complaint dated 12.7.2015 said to have been made by the petitioner herein.

2. Today when the matter is taken up, written instructions dated 27.7.2015 furnished by the Sub-Inspector of Police, Ibrahimpatnam Police Station, Cyberabad Commissionerate have been placed on record by the Government Pleader for Home appearing for respondents. In the said instructions, it is stated that after filing the present writ petition, the police thoroughly verified the records in the Police Station including Station General Diary and could not find any complaint endorsed by the office of the Commissioner of Police, Cyberabad. It is further stated that the police is ready and willing to take action on the complaint dated 12.7.2015 if the endorsement is made by the Commissioner of Police. It is also stated that the petitioner did not approach the police till date nor any fresh complaint is made and it is also stated that the petitioner is always at liberty to approach the Police and lodge a fresh complaint.

3. On noticing the said instructions, it is submitted by the learned counsel for the petitioner that the petitioner herein will file necessary complaint before the Police and the Police may be directed to take action in accordance with law. The learned counsel also requested the Court to record the said written instructions.

4. In view of the above, while recording the written instructions dated 27.7.2015 furnished by the Sub-Inspector of Police, Ibrahimpatnam Police Station, Cyberabad Commissionerate, the writ petition is disposed of, keeping it open to the petitioner herein to approach the Respondent

Police and file necessary complaint, if so advised. If any such complaint is made by the petitioner, the Respondent Police shall consider the same and take appropriate action, in accordance with law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
