HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30559 of 2016 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in contemplating to evict the petitioners from their schedule lands in Survey Nos.1952, 1949, 1948, 1951 and 1952 in an extent of Ac.2.00 each, though the said lands are assigned to the petitioners, without issuing any notice and without following any due process of law, as illegal and arbitrary and for a consequential direction to the respondents not to evict the petitioners from the subject land.
Learned counsel for the petitioners submits that the Government having recognized the petitioners' long possession over the subject lands, gave provisional assessment orders.
Learned Assistant Government Pleader for Revenue submits that steps are being taken to issue show cause notice to the petitioners and that they would follow due procedure in case the respondent authorities take action against the petitioners.
In view of the above, the writ petition is disposed of directing the respondents not to evict the petitioners from the subject lands, without following due process of law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
