HCJ & AAR, J F.C.A. No. 166 of 2019 Dt: 16-10-2019 Judgment: (per Hon'ble The Chief Justice Raghvendra Singh Chauhan) The appellant-husband has filed this appeal against the common judgment dated 31-07-2019, in FCOP.No. 258 of 20176, on the file of the XVI Additional District Judge -cum- III Additional Family Judge, Ranga Reddy District at Malkajgiri, whereby the learned Family Judge has allowed the petition for restitution of conjugal rights, filed by the respondent-wife and dismissed another petition, namely FCOP.No. 1370 of 2016, filed by him for divorce.
Aggrieved by the said common judgment, the appellant has filed the present appeal, and another appeal, namely FCA.No. 165 of 2019. During the pendency of the appeals, the parties have entered into a compromise. In FCA. No 165 of 2019, they have filed an application under Section 13-B of the Hindu Marriage Act, 1955 (for short 'the Act'), which has been allowed today by this Court. In the light of the divorce granted on the basis of mutual consent under Section 13-B of the Act, this appeal has become infructuous. It is, hereby, dismissed as infructuous.
As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
