HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8786 of 2015 O R D E R :

The petitioner, who is the accused No.2 in C.C. No.106 of 2014 on the file of the Judicial Magistrate of First Class, Venkatagiri, for the alleged offences punishable under Sections 20(i)(ii)(iii)(iv) and (x) of A.P. Forest Act, 1967 and Rules 3 and 4 of A.P.Sandal Wood and Red Sanders Wood Transmit Rules, 1969, Rule 3 of A.P. Red Sander Wood Possession Rules, 1989, Section 7, 24(1) of Bio-Diversity Act, 2002 read with Section 29(2) (b) of A.P. Forest Act, 1967 punishable under Section 29(4) (a) of A.P.Forest Act, Section 55 of Bio-Diversity Act, 2002 and Section 379 I.P.C, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The charge-sheet has already been filed in this case and the trial Court has taken cognisance of the said charge-sheet. N.B.W. is pending against the petitioner-accused No.2. Considering the facts and circumstances of the case, the petitioner-accused No.2 is directed to surrender before the Magistrate concerned and file petition to recall N.B.Ws. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused No.2 is directed to report before the trial Court on all hearing days. With the above observation, the Criminal Petition is disposed of.
