CVNR, J & PKR, J CMA.No.682 of 2018 Dated:01.11.2018 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) At the interlocutory stage, the Civil Miscellaneous Appeal is heard and being disposed of with the consent of learned counsel for both the parties.

The appellant has filed O.S.No.618 of 2014 on the file of the XXIV Additional Chief Judge, City Civil Court, Hyderabad, inter alia for declaration of title and delivery of possession of fourth and fifth floors of the suit schedule property. The appellant has also filed I.A.No.856 of 2014 for an interim injunction restraining respondent No.1 from alienating the petition schedule property during the pendency of the suit. The said application having been dismissed, the plaintiff filed this appeal.

During the hearing, Dr. Pundla Bhaskara Mohan, learned counsel for respondent No.1, fairly submitted that the trial of the afore-mentioned suit is at an advanced stage and that, his client undertakes not to sell any part of the suit property pending disposal of the suit.

In the light of the above submission, the order under appeal is set aside. Respondent No.1 is restrained from alienating or in any manner transferring the interests in the suit schedule property to third parties pending the suit.
