THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12001 OF 2009 ORDER:

The complaint in the present writ petition is alleged interference of the 3rd respondent police in civil disputes.

2. When the matter is called, written instructions dated 14.06.2016 furnished by the Assistant Sub-Inspector of Police, Samalkota Police Station, East Godavari District, have been placed on record by the learned Government Pleader and the said written instructions read as under:

"The petitioner herein was involved in Cr.No.115/2005 /s.324 r/w. 34 IPC on the file of Samalkota Police Station. The case was charge sheeted on 26.06.2005 vide C.C.No.46/2009. The case ended in acquittal on 13.04.2010 before the Hon'ble Special Judicial 2nd Class Magistrate Court, Kakinada. The petitioner also involved in Cr.No.82/2005 U/s.107 Cr.P.C. The Hon'ble Mandal Executive Magistrate, Samalkota bound over the petitioner. It is submitted that the contention of the petitioner that the respondent police interfered with the civil dispute is false, hence denied. At present no fresh cases were registered against the petitioner herein on the file of this respondent police station, hence the question of calling him to the police station, does not arise.

As per the writ averment the petitioner filed ATC No.9/2009 before the Special Officer, for Tenancy cum Principal Junior Civil Judge, Kakinada, for which the respondent police has nothing to do."

3. On noticing the same, it is requested by the learned counsel for the petitioner to place the said written instructions on record and dispose of the writ petition.

4. For the aforesaid reasons, Writ Petition is disposed of, placing

on record the written instructions dated 14.06.2016 furnished by the Assistant Sub-Inspector of Police, Samalkota Police Station, East Godavari District.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 20.06.2016 SS
