HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.450 of 2007 ORDER:

When the matter is taken up for hearing, the learned Government Pleader appearing for petitioner submits that the 1st respondent was reinstated into service in pursuance to the orders passed by the Industrial Tribunal in I.D.No.162 of 2003 and during the pendency of this writ petition, separate disciplinary proceedings were initiated against the 1st respondent-workman and the 1st respondent-workman was removed from service on 26.09.2008. Challenging the said orders of removal, the 1st respondent-workman has filed writ petition No.880 of 2009. In view of the same, he contends that the cause in the writ petition does not survive and the writ petition has become infructuous. In view of the above submission of the learned Government Pleader, the writ petition is dismissed as infructuous. No order as to costs.
