THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28708 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the Respondent Authorities on Petitioner's Complaint, dt.20.08.2015 as illegal, arbitrary, biased, unconstitutional and against the principles of natural justice and consequently direct the Respondent Authorities to take action on Petitioner's Complaint, dt.20.08.2015."

Heard Smt.D. Lalitha Prasad, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, written instructions, dated 09-09-2015 furnished by the Sub-Inspector of Police, Krishna Giri Police Station, Dhone Circle, Kurnool District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is respectfully submitted that one Chilaka Chandra Shekar Reddy the petitioner herein stating that he is the owner of the land Ac.3.48 cents covered by Sy.No.693/A & 693/B of Chunchu Yerrigudi Village, Krishnagiri Mandal, Kunool District having purchased the same through a registered sale deed on 06.05.2015 from Mangali Srinivasulu and some others,. It is further submitted that the petitioner made it fit for cultivation of commercial crops like ground nuts and jowar, red gram. While the things stood one Gongala Ramudu/the 5t h respondent herein and others came to the petitioner and demanded fund for their vices in the month of July claiming that they are residents of that village. And they are also tried to attack him with deadly weapons at their above fields, hence requested to take necessary action by the S.H.O. Krishna Giri Police Station Kurnool District.

It is humbly submitted that the said complaint dt.20.08.2015 was not received in the police station and the copy filed with the writ petition is also not bearing any stamp thus it is denied.

It is further submitted that as of now the respondent police did not receive any complaint from the petitioner herein. As and when the petitioner approaches the S.H.O.

with a complainant, the respondent police will take steps to register the case as per Law."

On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition with a liberty to the petitioner herein to approach the police by way of complaint. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 09-09-2015 furnished by the Sub-Inspector of Police, Krishna Giri Police Station, Dhone Circle, Kurnool District and keeping it open for the petitioner herein to make a complaint before the police concerned. If any such complaint is received by the police authorities, the same be enquired into, in accordance with law.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
