THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27505 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.9A of Kothapullareddygudem Village, Veldurthi Mandal, Guntur District. The authorization of the petitioner is valid upto 31.03.2016. While so, the fifth respondent inspected the shop of the petitioner on 01.03.2015 and found some variations in the stock. Based on the same, 6-A proceedings were initiated and they are pending and no action was taken by the fourth respondent. When the commodities were not released, the petitioner filed W.P.No.7979 of 2015, and this Court disposed of the same on 25.07.2015, directing the respondents to supply the essential commodities to the petitioner. Pursuant to the same, an order was passed on 12.05.2015 directing the fifth respondent to supply the commodities. It appears that the fourth respondent issued a show cause notice to the petitioner on 30.03.2015 and the petitioner submitted her explanation on 16.04.2015. The authorization of the petitioner was suspended on 20.04.2015. When enquiry was not completed, the present writ petition is filed.

In the facts and circumstances of the case, it appears that the fourth respondent passed an order on 12.05.2015 directing the fifth respondent to supply the essential commodities to the petitioner until further orders. Now an explanation is also submitted by the petitioner on 16.04.2015 and the enquiry is pending before the fourth respondent. 4.

In the circumstances, this Court is not inclined to examine the validity of the charges leveled against the petitioner and the fourth respondent is directed to complete the enquiry within 30 days from the

date of receipt of a copy of this order, after giving due opportunity to the petitioner.

5. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
