THE COURT MADE THE FOLLOWING:
ORDER:
This writ petition is filed for the following substantive relief: "...to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 2nd respondent in refusing to permit the petitioner to write 2nd year PG Medicine (M.S. (Ortho)) final examinations to be held in April, 2012, through Letter Lr No.035/PG/E2(B)/Deg/Dip/Exams, dt.22-12-2011, on the alleged ground that the petitioner has only 33.
7 per cent attendance with an absence of 242 days in the 2nd year, as being illegal, arbitrary, unjust and without jurisdiction, apart from being violative of the fundamental rights guaranteed to the petitioner under the Constitution of India; as well as being violative of the principles of natural justice; and consequently, set aside the proceedings of the 2nd respondent in letter No.035/PG/E2(B)/Deg/Dip/ Exams, dt.22.12.2011, and further consequently direct the respondents herein to permit the petitioner to write the final examinations of the 2nd year PG Course in MS (Orthopaedics) to be held in April, 2012, by receiving his application and by issuing the necessary hall-ticket and other incidental permissions." At the hearing, Mr. K. Manoj, learned counsel representing Mr. J.N.
Bhushan, learned counsel for the petitioner, submitted that the cause in the writ petition does not survive for adjudication. In view of the above submission, the writ petition is dismissed as infructuous.
As a sequel to dismissal of the writ petition, interim order dt.2.3.2012 shall stand vacated and W.P.M.P. No.6911 of 2012 shall stand disposed of as infructuous.
