THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.36342 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in not providing alternative employment in terms of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Participation) Act, 1995, inspite of repeated visits made by the petitioner followed by the written representation dt.26-9-2015, as being illegal, arbitrary and unjust and consequently direct the respondents to provide the alternative employment, to the petitioner."

Heard, Sri G. Rajesh, learned counsel for the petitioner and Sri B. Mayur Reddy, learned Standing Counsel for respondents. When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2609-2015 to the 2nd and 3rd respondents herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 2nd and 3rd respondents to pass appropriate orders on the representation, dated 26-09-2015, in accordance with law, by fixing some timeframe. On the other hand, it is contended by learned Standing Counsel for respondents that on an application made by the petitioner, the petitioner herein was allowed to retire on medical

grounds, as such, the relief sought in the writ petition cannot be maintained. It is further submitted by the learned Standing Counsel that the respondents will pass appropriate orders on the representation, dated 26-09-2015 said to have been passed by the petitioner.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, directing the 2nd and 3rd respondents to consider and pass appropriate orders on the representation, dated 26-09-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
