HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRL.P.M.P. NO.10137 OF 2015 IN/AND CRIMINAL PETITION No.15366 OF 2014 ORDER :

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code') by the petitioners 1, 2, 5 and 6/ Accused 1, 2, 5 and 6 seeking to quash the proceedings in FIR No.87 of 2011 of P.S. Mahanandi, Kurnool District (now transferred to Mahabubnagar Rural Police station), registered against them for the offences punishable under Sections 498-A and 506 of the Indian Penal Code, 1860 and Section 156(3) of the Code of Criminal Procedure, 1973. . The de facto complainant filed a joint memo of compromise in Crl.P.M.P.No.10137 of 2015 seeking permission for compromise in the matter by compounding the said crime. The parties stated that they wanted to purchase peace and they have settled their disputes outside the Court. In the Joint Memo, it is mentioned that the parties agreed to compromise and executed MOU and as per MOU the petitioners deposited an amount of Rs.8,00,000/- vide D.D. No.850860 dated 21.09.2015 drawn on SBI, Hyderabad Main Branch, as full and final settlement.

3. Having regard to the above, to sub-serve the ends of justice by invoking Section 482 of Cr.P.C. permission is accorded and Crl.P. M.P. No. 10137 of 2015 is ordered and the offences supra are compounded.

4. Consequently, the Criminal Petition is allowed and all the proceedings relating to FIR No.87 of 2011 of P.S. Mahanandi, Kurnool District (now transferred to Mahabubnagar Rural Police Station, Mahabubnagar District) against the petitioners 1, 2, 5 and 6, are quashed. The bail bonds of petitioners 1, 2, 5 and 6/ A.1, 2, 5 and 6, if any, shall stand cancelled.

5. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
