THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4568 of 2009 ORDER:

Alleging inaction on the part of respondents in releasing the amounts due in respect of work contract, the present writ petition is filed.

2. This Court on 07.09.2009, in WPMP.No.6004 of 2009, granted interim direction directing the respondents 1 to 3 to consider the representation filed by the petitioner on 03.12.2008 for redressal of his grievance.

3. A counter affidavit is filed by the Executive Engineer (R&B) Division, Vizag Circle, Paderu Division, Visakhapatnam stating that due to nonrelease of funds by the office of the Director of Medical and Health, the amounts could not be paid to the petitioner.

4. A counter affidavit is filed by the Director of Health, Andhra Pradesh, Hyderabad stating that the fourth respondent has already made available funds to respondents 1 to 3 for release of the same to the contractor.

5. In view of the above reasons, the interim direction granted by this Court on 07.09.2009 directing the respondents to consider the representation of the petitioner dated 03.12.2008 is made as final order in the writ petition. Accordingly, the writ petition stands disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
