HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.20284 of 2017 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents 2 and 3, more particularly the respondent No.3 in issuing the Notice vide No.174/A(Part)/8/5/RW/ACP/C8/GHMC/2017 dated 12.6.2017 by forcing the petitioner to give consent and handover the premises bearing Municipal No.5-8-174/A, consisting of Ground Floor with Shop and First Floor, admeasuring 103.33 square yards or 86.38 square meters out of 312 square yards or 262 square meters on eastern side, situated at Nampally, Hyderabad, as illegal and arbitrary. 2.

Heard Sri Mohd.Zia-ul-Haque, learned counsel for the petitioner and the learned Government Pleader for Municipal Administration appearing on behalf of the respondent No.1 and Sri N.Ashok Kumar, learned standing counsel for respondent Nos.2 and 3 and perused the material available on record. 3.

From the notice dated 12.6.2017, it is evident that the petitioner is given time for 15 days to give his consent. The petitioner is at liberty either to accept the demand of the respondents or he can give a letter dissenting to the request of respondents herein. Counsel for respondents also informed that on such letter received from the

petitioner, they will follow the due process in proceeding with this matter. The petitioner is directed to give his explanation on or before 30-6-2017.

Recording the submissions of counsel for respondents, the Writ Petition is disposed of. There shall be no order as to costs. 5.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
