HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.1103 of 2011 ORDER:

This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C'), seeking to quash the proceedings in C.C. No.386 of 2006 on the file of the Court of Additional Judicial First Class Magistrate, Vizianagaram.

2. The case arise out of a private complaint filed by the first respondent herein. The petitioner is A.1 and it is alleged that he being the Managing Director of M/s. Amrutha Finance Company Limited, Visakhapatnam, has misused the cheques and other documents given to him at the time of availing loan. In view of the nature of the allegations, it is not a fit case where further proceedings need to be quashed.

3. In the result, the Criminal Petition is dismissed. The learned Magistrate shall dispose of the calendar case, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order.

Miscellaneous petitions pending, if any, in the Criminal Petition shall stand closed.
