HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.20438 OF 2017 ORDER:

This Writ Petition is filed by the petitioners with the prayer which reads as follows:- " To issue an appropriate Writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents authorities in particularly respondent No.3 to 8 in digging the AMRP canal in contrary to alignment fixed by the Technical Officers at the time of land acquisition in Sy.Nos. 282,283 and 271 situated at Inupamula Revenue village of Kethapally Mandal, Nalgonda District as illegal, arbitrary and against the principles of natural justice and consequently direct the respondent Nos.3 to 8 to follow the alignment fixed at the time of land acquisition in Sy.Nos.282,283 and 271 situated at Inupamula Revenue village of Kethapally Mandal, Nalgonda District and follow the due procedure, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioners and also the learned Govt.Pleader for Irrigation for respondents 2 and 4 and the Govt.Pleader for revenue representing respondents 1, 3, 5 to 7 and learned Govt. Pleader for Land Acquisition for Respondent No.7, dismissing the Writ Petition against R.8 for no way personally liable for the Writ Petition averments, in recording the submission of their proceeding as per the approved alignment and the contention of the petitioner of diverting the same is not correct.

Having regard to the above, the Writ Petition is disposed of by making it clear that if at all the respondents want to divert alignment into any extent of the petitioners' property other than extent they have acquired, that can only through due process of
