HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 29487 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 3714 of Akkapalli village, Yellareddypet Mandal, Karimangar District. While so, The Deputy Tahsildar submitted a report on 21.11.2013, pursuant to which, second respondent issued a show cause notice on 23.11.2013 and on the same day, the authorization of the petitioner was suspended pending enquiry. The petitioner submitted her detailed explanation on 5.12.2013. However, as no enquiry was conducted and authorization of the petitioner was not restored, the present Writ Petition is filed.

As many as four charges are levelled against petitioner in

the show cause notice dated 23.11.2013. However, as the petitioner has already submitted her explanation on 5.12.2013 to the said show cause, the second respondent ought to have completed the enquiry into the allegations levelled against the petitioner in the light of the explanation submitted on 5.12.2013 within a period of thirty days from the date of passing the order suspending the authorization.

Having regard to the same, the second respondent is directed to complete the enquiry by giving due opportunity to the petitioner and pass final order within a period of thirty days from the date of receipt of a copy of this order.

Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
