HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11550 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the inaction of the 2nd respondent either in disposing of the stay petition or the main case pending before him against the proceedings of the 3rd respondent dated 30.09.2014, as illegal and arbitrary.

3. The authorisation of the petitioner's fair price shop was suspended by the 3rd respondent vide order dated 30.09.2014 on the ground that in the course of inspection certain variations in the stock have been noticed. Learned counsel appearing for the petitioner submits that the variations in the stock allegedly noticed are within the permissible limits. However, the petitioner preferred an appeal to the 2nd respondent-Joint Collector (CS), Srikakulam on 18.10.2014 along with stay petition and the same is pending. The grievance of the petitioner is that so far no orders have been passed in the stay petition nor appeal has been disposed of. 4 . Under these circumstances, the 2nd respondent-Joint Collector, Srikakulam, is directed to dispose of the appeal filed by the petitioner on 18.10.2014 against the orders of the 3rd respondent dated 30.09.2014, within a period of six (6) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
