THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7009 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 2 seeking anticipatory bail in the event of their arrest in connection with Crime.No.154 of 2023 on the file of Karimnagar Rural Police Station, Karimnagar District, registered for the offence under Section 324 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The allegation against these petitioners is that they have assaulted de-facto complainant with beer bottles, stone sticks and chilli powder along with A-3 and A-4. The said incident happened on 03.06.2023. Even according to the de-facto complainant, there were money disputes between the 1st petitioner and himself. As seen from the medico legal certificate, the injuries were on the ankle, upper limbs and also on the head.

Keeping in view, there were money disputes between the defacto complainant and the petitioners, for which reason

altercation took place, this Court is inclined to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused No.1 and 2 are directed to surrender before the Station House Officer, Karimnagar Rural Police Station, Karimnagar on 08.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 and 2 on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.1 and 2 shall appear before the concerned police every day from 08.08.2023 till 29.08.2023 at 10.00 a.m.

and thereafter, as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
