HONOURABLE SRI JUSTICE P.NAVEEN RAO Date: 18.09.2019 Between:
A.Naresh Kumar s/o. A.Venkateswarlu, Aged about 34 years, R/o. 2-62/B, Gudibanda village, Kodada Mandal, Suryapet District, previously under Nalgonda district.
.....Petitioner and The Telangana State Northern Power Distribution Company Limited, rep.by its Chairman and Managing Director, Corporate Office: Warangal Town, Warangal district and others.
.....Respondents The Court made the following:
HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
In pursuant to the Notification No.1/2018, dated 16.02.2018 to fill up the posts of Junior Lineman, petitioner participated in the selections. Having qualified in the written examination, he was subjected to Pole Climbing Test on 18.01.2019, but he failed. Contending that on that day, there was fracture to his right hand, and therefore could not do pole climbing properly, he made representation on 13.02.2019 for giving further opportunity. Alleging inaction on the said representation, this Writ Petition is filed.
2.
It is not in dispute that petitioner participated in the selections including pole climbing test, which is mandatory requirement for being selected and having failed, he cannot ask for conducting separate pole climbing test to him on the ground that he suffered fracture injury to his right hand. When specifically asked, learned counsel for petitioner is unable to point out the provision which makes out such recourse and non-consideration of the same would be amounting to arbitrary exercise of power warranting interference by this Court. I see no merit in the Writ Petition.
Accordingly Writ Petition is dismissed.
Pending miscellaneous petitions shall stand closed.
