THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21040 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the respondent in issuing rejection order dated 16.05.2017 without giving prior notice and without giving opportunity to the petitioner, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Standing Counsel for the sole respondent. With their consent, the Writ Petition is disposed of at the stage of admission itself. Though various grounds are raised in the Writ Petition, at the time of hearing, the learned counsel for the petitioner submits that the petitioner may be permitted to file an appeal before the authorities concerned and the same may be directed to be considered by the authorities at the earliest. The same is not seriously opposed by the learned Standing Counsel.

Having regard to the above, the Writ Petition is disposed of directing the petitioner to prefer an appeal against the order dated 16.05.2017 passed by the respondent, within a period of one week from the date of receipt of a copy of this order, in which event, the authorities shall deal with the same and pass orders, in accordance with law, within a period of two weeks from the date of filing of such appeal.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
