HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims that land to an extent of Ac.3.23 guntas in Sy.No.262/1 of Sarapaka village, Burgampahad Mandal, Bhadradri-Kothagudem district is proposed for assignment to petitioner having recognized her eligibility and possession. Petitioner alleges that on the ground that land is required for some other purpose, petitioner is sought to be dispossessed without following due process.

Admittedly, no assignment is granted to petitioner.

Assuming that petitioner is in possession, such possession is illegal. So far no proceedings are initiated, as alleged, dispossessing the petitioner from the subject land. In other words, this writ petition is filed praying to prevent the respondent authorities from action that can be taken against the petitioner. It cannot be said that if petitioner is in possession, he would be dispossessed without following due process. Writ petition is disposed of, leaving it open to petitioner to work out his remedies if petitioner is in possession and dispossession takes place without following due process.

Pending miscellaneous petitions stand closed. There shall be no order as to costs.
