HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.193 of 2002 JUDGMENT:

This appeal is preferred challenging the judgment and decree in A.S.No.401 of 2000 on the file of I Additional Senior Civil Judge, Visakhapatnam, dated 20.03.2001, whereunder judgment and decree dated 27.09.1996 in O.S.No.138 of 1985 on the file of District Munsif, Bheemunipatnam is confirmed.

When this matter was listed on 03.11.2015, advocate for appellants requested time till 12.11.2015, and on his request, it was adjourned with an observation that no further adjournment will be granted. On 12.11.2015, there was no representation on behalf of appellants. Therefore, the matter was posted to this date under the caption 'for dismissal'. In spite of that, no interest is evinced in prosecuting the case.

Advocate for respondents represented that this appeal is coming since 2002 and the appellants have not shown any interest. Considering the above reasons, this Second Appeal is dismissed for non-prosecution. No costs. Miscellaneous petitions, if any pending, in this appeal shall stand closed.
