ORDER

The petitioner-Andhra Pradesh Grameena Vikas Bank filed this writ petition seeking to issue Writ of Mandamus declaring the action of the respondents in trying to disburse the compensation amount to the borrowers of the petitioner-Bank without obtaining No-objection Certificates from the petitioner-Bank pursuant to the Notification issued under Section 4 (1) of the Land Acquisition Act vide No.G/1093/2007, dated 29.05.2007 published in Andhra Prabha Telugu Daily News paper dated 13.06.2007 as well as Section 6 declaration issued vide No.G/1093/2007, dated 15.06.2007 published in Praja Shakti Telugu Daily News Paper dated 15.6.

2007 as illegal, arbitrary and opposed to the provisions of Land Acquisition Act and Transfer of Property Act and consequently to direct the respondents not to disburse the compensation amount payable to the borrowers without producing the No Objection Certificates from the petitioner Bank. On 3.9.2007, while admitting the writ petition, this Court in WPMP No.19243 of 2007 granted interim direction as prayed for. When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that pursuant to the said direction, compensation was paid to the land oustees after obtaining No Objection Certificates long back as per the award and hence, the cause in this writ petition does not survive for adjudication.

Recording the said submission, the Writ Petition is dismissed as infructuous. No costs.
