THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.396 of 2000 ORAL ORDER:

Since there was no representation for the appellant on 29.1.2018, Registry was directed to list the present Second Appeal under the caption 'For Dismissal'. Today also, there is no representation for the appellant.

In fact, the suit was filed in the year 1985 for declaring the Notice, dated 29.1.1985 asking to pay tax of Rs.17,394/- under Assessment No.41392, and consequently for permanent injunction. It appears that the appellant is not diligent in prosecuting the matter.

Hence, the present Second Appeal is dismissed for non-prosecution.
