HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.7678 of 2015 ORDER:

This Criminal Petition is filed by the petitioners under Section 438 Cr.P.C. seeking anticipatory bail in the event of their arrest in an unregistered crime on the file of Ramannapet Police Station, Nalgonda District.

It is stated that the marriage of the 1st petitioner with defacto complainant was solemnized on 24.02.2012 and they were blessed with a baby girl on 04.11.2012 and thereafter due to disputes, the defacto complainant left the marital home in the year 2014. It is further stated that the defacto complainant lodged a complaint against the petitioners herein for the offence under Section 498-A I.P.C. and also under the provisions of the Dowry Prohibition Act. Normally, this Court would not have entertained this petition. On mere apprehension only, the petitioners filed the present petition.

In that view of the matter, I consider it appropriate to dispose of this Criminal Petition with a direction to the police, Ramannapet, Nalgonda District, to register the complaint, if the allegations in the complaint prima facie reveal the commission of alleged offence by the petitioners herein, and then proceed with the investigation. However, the petitioners herein shall not be arrested without following the procedure as contemplated under Section 41A Cr.P.C. _________________ M.S.K.
