THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.37981 of 2013 O R D E R:
This writ petition, filed under Article 226 of the Constitution of India, seeks the following relief:
"Issue an appropriate writ, order or direction more particularly one in the nature of Writ of MANDAMUS (a) declaring the action of the respondents in proposing to retire the petitioner from service on attaining the age of 58 years instead of 60 years vide Roc.No. E5/8052/2010 dated 20-122013 as arbitrary and against the Provisions of Act 23 of 1984 which has been made appliable to the Tirumala Tirupati Devsthanam by virtue of G.O.Ms.No. 1060 Revenue (Ends.III) Department dated 24-1-1989 b) consequently direct the respondents to continue the petitioner in service till such time he attains the age of 60 years which is the normal age of retirement for workman of the Tirumala Tirupati Devasthanam Printing Press with all consequential benefits."
2. Today, when the matter is called, it is submitted by the learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the common by this Court in W.A.No.230 of 2003 and Batch, dated 27.07.2010 and W.P.No.15234 of 2013, dated 29.05.2013 and the copies of the same are filed along with the writ petition as material paper.
3. Following the above referred common order and for the reasons recorded therein, this writ petition is allowed, directing the respondents herein to release pension benefits of the petitioner by treating the date of retirement of the petitioner as 31.12.2015. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
