THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19747 of 2019 ORDER:

Heard learned counsel for petitioners and learned Standing Counsel for Hyderabad Metropolitan Development Authority (HMDA) appearing for the first respondent.

In this Writ Petition, petitioners challenge the action of respondents in not demolishing the building, which was constructed illegally by Mr. Kalakanti Sreenivasa Reddy, in Survey No.450/A situated at Gummadidala GP Village & Mandal, the then Medak District and presently, Sanga Reddy District.

It is the case of the petitioners that the first petitioner submitted a representation to the first respondent - Hyderabad Metropolitan Development Authority (HMDA), rep. by its Commissioner, Hyderabad, on 08.08.2019, for demolition of the subject building on the ground that it was constructed illegally and without taking any permission.

A perusal of the material papers, particularly, letter dated 24.05.2019 addressed to the first respondent by the Public Information Officer/Planning Officer (YR), filed along with the Writ Petition, discloses that on 04.04.2019, an application was

CKR, J W.P.No.19747 of 2019 submitted by the first petitioner under the provisions of the Right to Information Act, 2005, and the said authority furnished information by such letter stating that there is no permission granted with respect to the illegal construction in the aforesaid Survey Number.

In those circumstances, the respondents are directed to take into consideration the representation dated 08.08.2019 stated to have been submitted by the first petitioner and take necessary action in accordance with law.

Subject to the above, the Writ Petition is disposed of. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 13th SEPTEMBER, 2019.
