Heard Mr.Srinivasa Srikanth for petitioner and the Assistant Government Pleader for Home.
The petitioner prays for Mandamus declaring the action of 2nd respondent in not registering the crime on the complaint dated 28.01.2013 filed by petitioner and not assigning any reason for not entertaining the complaint, as illegal and unconstitutional. The Assistant Government Pleader, on instructions, submits that after receiving the complaint, an entry in General Diary (GD) was made and preliminary investigation disclosed that the grievance sought to be canvassed through the complaint is a pure and simple civil dispute. According to him, the petitioner has to workout remedies before a competent civil Court. He further submitted that the 2nd respondent will communicate the outcome of preliminary investigation to petitioner within four weeks from the date of receipt of a copy of this order.
The statement of Assistant Government Pleader is accepted. Consequently, the 2nd respondent is directed to communicate the outcome of investigation on the entry made in this behalf. The writ petition is disposed of as indicated above. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any pending, stand closed.
